These Terms and Conditions ("Terms") govern the use of the Automobil Deal website ("Platform") by users ("Users").

1. Scope

By accessing the Platform, Users agree to these Terms.

2. Services of the Platform

Automobil Deal is an online platform for presenting, searching and matchmaking offers, promotions, discounts, products or services from third-party providers.

The Platform may aggregate, analyse or display offers automatically or manually.

The Operator reserves the right to adapt, restrict or discontinue content, features or services at any time.

3. No contract with the Operator

The offers shown on the Platform originate from third parties.

Contracts for products or services are concluded exclusively between the User and the relevant third party.

The Operator is not a party to transactions concluded on external websites.

4. Prices, offers and availability

All information on prices, discounts, availability, delivery times or promotions is provided without warranty.

Offers may be time-limited and changed or removed at any time.

The Operator accepts no liability for: incorrect price information, expired promotions, technical errors, incorrect product information, unavailable offers.

Only the information on the website of the respective third party is authoritative.

5. Affiliate links and commissions

The Platform may contain so-called affiliate or partner links.

If Users purchase products or services through such links, the Operator may receive a commission.

This generally does not result in any additional costs for the User.

6. Use of the Platform

The Platform may only be used in compliance with applicable laws.

In particular, the following are prohibited: misuse of the Platform, automated scraping without consent, circumvention of technical protection measures, distribution of unlawful content, interference with the security or functionality of the Platform.

The Operator may block Users or restrict access in the event of violations.

7. Intellectual property

All content on the Platform, in particular texts, logos, designs, graphics, databases, software and trademarks, is protected by copyright or other rights.

Without prior written consent of the Operator, content may not be copied, distributed, published or used commercially.

8. Availability

The Operator strives to ensure availability of the Platform that is as uninterrupted as possible.

However, there is no entitlement to permanent accessibility or error-free use.

Maintenance work, technical malfunctions, force majeure or external influences may cause interruptions.

9. Disclaimer of liability

To the extent permitted by law, any liability of the Operator is excluded.

In particular, the Operator is not liable for: direct or indirect damages, lost profits, data loss, damages caused by external links, third-party content, or decisions or purchases based on Platform content.

Use of the Platform is at the User's own risk.

10. External links

The Platform may contain links to external third-party websites.

The Operator assumes no responsibility for the content, data protection practices or offers of external websites.

The content of linked sites is the sole responsibility of their operators.

11. Data protection

The processing of personal data is carried out in accordance with the Platform's separate privacy policy.

By using the Platform, the User consents to the processing of their data in accordance with the privacy policy.

12. Changes to the Terms

The Operator may amend these Terms at any time.

The version applicable is the one published on the Platform at the time of use.

13. Severability

Should individual provisions of these Terms be or become wholly or partially invalid, the validity of the remaining provisions shall not be affected.

The invalid provision shall be deemed replaced by a legally permissible rule that comes as close as possible to the economic purpose.

14. Applicable law and place of jurisdiction

Swiss law applies exclusively, to the exclusion of conflict-of-law rules.

Place of jurisdiction is Zurich, Switzerland, subject to mandatory statutory provisions to the contrary.
